1. Acceptance of These Terms

By downloading, accessing, or using Trucker Pay, you agree to these Terms of Service and Disclaimer. If you do not agree with these terms, do not use the app or website.

2. Purpose of Trucker Pay

Trucker Pay is intended to help company truck drivers organize load information and estimate their earnings before payday. All calculations are based on information entered by the user and are provided for informational and planning purposes only.

3. License to Use the App

Trucker Pay grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the app for lawful personal use.

The app is licensed, not sold. You may not copy, resell, rent, distribute, modify, reverse engineer, attempt to obtain the source code, or use Trucker Pay for an unlawful purpose, except where applicable law expressly permits such activity.

4. User Accounts

Some features may require an account.

You are responsible for:

- Providing accurate account information

- Protecting your password and login credentials

- Activities performed through your account

- Contacting Trucker Pay if you believe your account has been accessed without permission

Trucker Pay may suspend or terminate access when an account is used unlawfully, fraudulently, abusively, or in violation of these terms.

5. User-Entered Information

You retain responsibility for the load, mileage, rate, deduction, tax, and other information you enter into Trucker Pay.

You grant Trucker Pay permission to process and store that information only as necessary to provide app functionality, account authentication, calculations, storage, and cloud synchronization.

6. Acceptable Use

You agree not to:

- Use Trucker Pay for unlawful or fraudulent activity

- Attempt to gain unauthorized access to another user's account or data

- Interfere with the operation or security of the app, website, or connected services

- Upload malicious code or misuse the service

- Copy, scrape, or commercially exploit the app without written permission

7. Ownership

Trucker Pay, including its name, branding, design, software, content, graphics, and original materials, is owned by Trucker Pay and its owner unless otherwise stated.

These terms do not transfer ownership of Trucker Pay or its intellectual property to the user.

8. Third-Party Services

Trucker Pay may use third-party services, including Supabase, Apple, and Google, for app distribution, authentication, storage, or cloud synchronization.

Your use of those services may also be subject to their separate terms and privacy policies.

9. Updates and Changes

Trucker Pay may add, remove, update, or discontinue features at any time.

Updates may be required for continued use of the app. We do not guarantee that every feature will remain available permanently.

10. Termination

You may stop using Trucker Pay at any time.

Trucker Pay may suspend or terminate access when reasonably necessary to protect the app, its users, its services, or to address a violation of these terms.

Upon termination, your right to use the app ends.

11. Estimates Only

All pay, tax, deduction, mileage, gross pay, and take-home pay calculations provided by Trucker Pay are estimates.

Actual pay may differ because of payroll processing, company policies, tax withholding methods, benefit deductions, load adjustments, mileage corrections, reimbursements, or other factors outside the control of Trucker Pay.

Trucker Pay does not guarantee that an estimate will exactly match an official paycheck.

12. Not Financial, Legal, Payroll, or Tax Advice

Trucker Pay does not provide financial, accounting, payroll, legal, or tax advice.

The app is not a substitute for advice from a qualified tax professional, accountant, attorney, financial advisor, employer, or payroll department.

13. User Responsibility

Users are responsible for entering accurate, complete, and current information.

Incorrect, incomplete, or outdated information may result in inaccurate estimates. Users should compare estimates with official pay statements and contact their employer or payroll department regarding differences.

14. No Employer Affiliation

Trucker Pay is not affiliated with, sponsored by, endorsed by, or connected to any trucking company, employer, payroll provider, government agency, or tax authority.

The app does not access or control employer payroll systems and cannot verify official payroll records.

15. Taxes and Deductions

Tax and deduction calculations are estimates based on user-entered settings.

Actual federal, state, Social Security, Medicare, insurance, retirement, child support, and other deductions may vary according to individual circumstances, changing laws, and employer payroll practices.

16. Availability and Warranty Disclaimer

Trucker Pay is provided "as is" and "as available."

We do not guarantee that the app or website will always be uninterrupted, completely secure, error-free, or suitable for every user's particular needs.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Trucker Pay and its owner will not be liable for financial losses, payroll disputes, missed payments, tax obligations, employment decisions, data loss, loss of profits, or other damages resulting from use of or reliance on the app or website.

Some jurisdictions do not permit certain warranty exclusions or liability limitations, so portions of this section may not apply to every user.

18. Apple App Store Terms

For users who obtain Trucker Pay through the Apple App Store:

- These terms are between the user and Trucker Pay, not Apple.

- Trucker Pay, not Apple, is responsible for the app and its content.

- Apple has no obligation to provide maintenance or support services for Trucker Pay.

- The user's license is limited to using the app on Apple-branded products owned or controlled by the user, subject to Apple's applicable usage rules.

- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce applicable provisions against the user.

19. Changes to These Terms

These Terms of Service and Disclaimer may be updated from time to time.

When changes are made, the Effective Date shown at the top of the page will be updated. Continued use after an update means the user accepts the revised terms.

Governing Law

These Terms of Service & Disclaimer are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.

Venue

Any legal action or proceeding arising out of or relating to these Terms of Service & Disclaimer or the use of Trucker Pay shall be brought exclusively in the state or federal courts located in the State of Minnesota. By using Trucker Pay, you consent to the jurisdiction and venue of those courts.
